State Polling Shows Consumers Agree – America Has a Lawsuit Abuse Problem

America has a lawsuit abuse problem, and it affects all of us. Nationwide, we’re all witnessing the effects of lawsuit abuse. Health care workers and manufacturers fighting COVID-19 are facing the threat of a lawsuit for the heroic work they’re doing. In California, businesses are being shut down over minor technicalities. In Florida, insurance rates are spiking due to excessive lawsuits and inaccurate claims. The list goes on, and it’s time we do something about it.

Citizens Against Lawsuit Abuse (CALA) stands with constituents in demanding a fair civil justice system.

In April 2020, CALA ran a poll across CALA states – California, Illinois and Florida – to catch a glimpse of what citizens think about the lawsuit abuse in our country and within their states.

Across the three states, over 90 percent reported that now is not the time to sue and while over 80 percent believe that healthcare workers should not have to consider the risk of being sued while fighting COVID-19.

 

California

COVID-19’s Impact on Californians’ Views of Lawsuits

  • 91.2% believe that now IS NOT the time to sue.
  • 84.1% believe that health care workers SHOULD NOT have to consider the risk of being sued while fighting COVID-19.
  • 75.9% believe that consumers SHOULD NOT sue over product flaws and manufacturers that are assisting in the COVID-19 effort.

Private Attorneys General Act (PAGA)

  • 75.2% of Californians do not believe that employers and small businesses should close their stores for minor or technical labor law violations.

Medical Injury Compensation Reform Act (MiCRA)

  • 91.0% of Californians do not believe doctors, nurses and medical professionals should base their decisions off of the liability of getting sued.

Illinois

COVID-19’s Impact on Illinoisans’ Views of Lawsuits

  • 92.4% believe that now IS NOT the time to sue.
  • 83.6%believe that health care workers SHOULD NOT have to consider the risk of being sued while fighting COVID-19.
  • 77.0%believe that consumers SHOULD NOT sue over product flaws and manufacturers that are assisting in the COVID-19 effort.

Data Privacy

  • 64.3% of Illinoisans do not believe that consumers should sue local businesses over personal data.
  • 56.6% of Illinoisans believe there should be real harm proven in lawsuits related to data privacy.

 

Florida

COVID-19’s Impact on Floridians’ Views of Lawsuits

  • 92.5% believe that now IS NOT the time to sue.
  • 80.8% believe that health care workers SHOULD NOT have to consider the risk of being sued while fighting COVID-19.
  • 79.7% believe that consumers SHOULD NOT sue over product flaws and manufacturers that are assisting in the COVID-19 effort.

Bad Faith

  • 81.3% of Floridians think it is unfair that insurance rates rise due to excessive lawsuits and inaccurate claims against insurance companies.

Medical Liability Reform

  • 91.1% of Floridians do not believe doctors, nurses and medical professionals should base their decisions off of the liability of getting sued.

Methodology: These state surveys were conducted in April 2020 under method: representative. The audience included users on website in the Google Survey Publisher Network, all ages and genders. 500 respondents collected in each state.
